Abstract. The market of road works is limited by the participants and even more limited by the road-building organizations furnished by the modern equipment and technologies, that initially cannot provide a perfect free competition. The strategic initiative of the state in the field of implementing road policy is impossible without ensuring a constant growth of the material basis and innovative products. Herewith leasing and alternate credit resource are the only possible instrument for their development. However, the lack of guaranteed and monotonously growing orders increases the risks of credit default, that often leading to bankruptcy. Federal Law No. 44-FZ absolutely does not take into account the specifics of the road infrastructure, which creates the numerous crisis situations resulting in the breakdowns of road work schedules, destabilization of the customer’s human potential and bankruptcy of contracting structures.

The level of corruption at the same time, finding new forms, shows a new scale of growth, and the economy of budgetary funds at the stage of an order placement is imaginary or false in nature. The severe restrictions of the customer’s capabilities provided with heavy fines and aimed at fight against corruption, on the contrary, strengthen it, involving in the relationship between customers and potential contractors (structures that actually perform works regardless of the results of bidding), as well as new subjects focused on destructive and diversion of budget funds abroad.
